I do not understand the legal theories, but it really seems like this year President Biden and VP Harris could be tempted to do legally questionable things before and after the election. If they do so and it leads to a bipartisan precedent that once you get power you can use the levers of power and and even summon a mob to try to stay in power, liberal democracy is on the way out.
Trump is not the peaceful, riding into the sunset, law abiding President who after losing an election, looked forward to writing his memoirs. Instead, he attempted to overthrow the government, by influencing a mob, and strong arming electors, Governors, and his Vice-President . He demanded that everyone around him comply with his crime. His actions can never fall under Presidential immunity. It would be criminal for any justice to allow Trump immunity.
